We may also receive information from payment providers, financial institutions, shipping providers, couriers, distributors, suppliers, Service Providers, fraud-prevention providers, event organizers, professional advisers, and other organizations involved in a legitimate transaction or business relationship.

A customer or organization may provide the business contact information of an employee, technician, representative, contractor, purchaser, accounts-payable contact, site contact, or other person where reasonably necessary for a legitimate business purpose.

Where appropriate and lawful, we may obtain business contact information from company websites, professional directories, public business records, professional networking services, trade shows, business cards, or other legitimate public or professional sources.

5.PURPOSES FOR WHICH WE USE PERSONAL INFORMATION

We may use personal information to respond to questions, provide requested information, understand customer requirements, communicate regarding products or services, prepare quotations, evaluate technical requirements, determine product or service suitability, communicate pricing and availability, maintain quotation records, accept and administer orders, process purchase orders, issue invoices, generate or provide payment links, process payments, arrange delivery, process refunds, administer taxes, and maintain transaction records.

6.CONSENT

Where consent is required by applicable law, 4Dsensing seeks meaningful consent appropriate to the sensitivity of the

personal information, the purpose for which the information is collected, reasonable expectations, the circumstances, and applicable legal requirements.

Consent may be express or implied where permitted by law.

Express consent will generally be sought where required because the information is sensitive, the use or disclosure would not reasonably be expected, the activity creates a meaningful residual risk of significant harm, or applicable law specifically requires express consent.

Where a collection, use, or disclosure is not necessary to provide a requested product or service, we will provide meaningful choice where required.

You may withdraw consent to future collection, use, or disclosure where processing depends upon consent, subject to legal restrictions, contractual restrictions, reasonable notice, and circumstances where continued processing is permitted or required by law.

Withdrawal of consent does not invalidate processing that lawfully occurred before withdrawal and may affect our ability to provide a product or service where the information is reasonably necessary to do so.

7.COOKIES AND SIMILAR TECHNOLOGIES

Our Website may use browser cookies, local storage, scripts, tags, pixels, consent-management technologies, and similar Website technologies.

Essential technologies may be used for Website operation, security, fraud prevention, session management, network management, consent-preference storage, authentication where applicable, and functionality specifically requested by the user.

Preference technologies may remember language, regional settings, accessibility preferences, privacy preferences, cookie choices, and similar settings.

Where enabled, analytics technologies may process information relating to Website traffic, page visits, navigation, approximate traffic source, browser type, device type, errors, performance, approximate geographic region derived from network information, and general Website usage.

If we use optional technologies for advertising, remarketing, conversion measurement, audience measurement, behavioural advertising, marketing attribution, or profiling, their use will be subject to applicable disclosure and consent requirements.

Where applicable law requires consent, non-essential technologies will be activated only after the required consent or user choice has been obtained.

We will not represent optional advertising or marketing technologies as technically necessary.

8.QUEBEC TECHNOLOGY AND PROFILING REQUIREMENTS

Where Quebec privacy legislation applies and the Website uses technology that includes functions allowing an individual to be identified, located, or profiled, we will provide the information and controls required by applicable law.

Where required by Quebec law, such functions will not be activated by default and the individual will be provided with a means to activate them.

Optional analytics, marketing, advertising, profiling, and similar non-essential functions may therefore remain disabled until the required user choice or consent has been obtained.

Essential Website security and functionality technologies may continue to operate where permitted by law.

9.COOKIE AND PRIVACY CHOICES

Where available, you may manage optional Website technologies through our cookie or privacy-preference interface, your browser, your device, or another applicable control.

Depending on your browser, you may be able to block cookies, delete cookies, restrict cookies from particular websites, receive notice when cookies are stored, or use private-browsing functionality.

Blocking technologies necessary for Website functionality may cause some features to function incorrectly.

Specific third-party technologies enabled on our Website may also be identified through the applicable cookie-consent or privacy-preference interface.

10.MARKETING AND COMMERCIAL ELECTRONIC MESSAGES

4Dsensing may send commercial electronic messages where permitted by applicable law.

Where Canada’s Anti-Spam Legislation (“CASL”) requires consent, we will obtain or rely upon an appropriate form of express or legally recognized implied consent.

Where required, commercial electronic messages will include identification of the sender, appropriate contact information, and a functioning unsubscribe mechanism.

You may unsubscribe from promotional communications at any time. Valid unsubscribe requests will be processed within the time required by applicable law.

Unsubscribing from promotional communications does not prevent us from sending necessary non-promotional communications regarding an existing order, quotation, invoice, payment link, payment, delivery, support request, service visit, warranty matter, security matter, contractual relationship, or legal notice.

11.PAYMENTS AND FINANCIAL INFORMATION

If you purchase products or services, we may process information reasonably necessary to complete, verify, document, and administer the transaction.

This may include customer or company name, billing address, shipping address, quotation information, purchase-order information, invoice number, transaction amount, currency, taxes, payment status, transaction date, payment reference, refund information, and accounting records.

11.1 PAYMENT LINKS

4Dsensing may provide customers with a payment link through email, an invoice, a quotation, the Website, or another authorized business communication channel.

A payment link may direct you to a secure payment page operated by 4Dsensing or by an authorized third-party payment provider.

When a third-party payment provider operates the payment page, payment information entered through that page may be collected and processed directly by the payment provider according to its own privacy policy, security practices, contractual obligations, and applicable law.

Depending on the payment method selected, the payment provider may process customer name, billing address, email address, telephone number, payment-card information, bank or payment-account information, transaction amount, currency, transaction identifier, and other information required to authorize or verify the payment.

Where complete payment credentials are entered directly into a third-party payment provider’s secure payment page, 4Dsensing does not intentionally receive or retain complete payment-card numbers, card security codes, banking passwords, or other complete payment credentials handled exclusively by that provider.

4Dsensing may receive limited transaction information from the payment provider, including payment status, transaction identifier, amount paid, payment date, payment method category, refund status, and other limited information reasonably necessary for accounting, payment reconciliation, fraud prevention, customer support, dispute management, or legal compliance.

Customers should verify that a payment link was received through an authorized 4Dsensing or 4Dindustrial communication before entering payment information.

If you are uncertain whether a payment request or payment link is authentic, contact 4Dsensing using independently verified contact information before making payment.

11.2 PAYMENT PROVIDERS

Payment may be processed through banks, card processors, financial institutions, electronic-payment providers, or other authorized payment services.

Where a third-party payment provider processes complete payment credentials directly, 4Dsensing does not intentionally retain complete payment-card information that is handled exclusively by that provider.

We may receive limited transaction information necessary to confirm payment, reconcile transactions, process refunds, administer orders, and maintain accounting records.

The applicable provider may independently process information under its own privacy policy and legal obligations.

11.3 BANK TRANSFERS AND WIRE TRANSFERS

Where payment is made by bank transfer, electronic funds transfer, wire transfer, cheque, or another business-payment method, we may process payer name, company name, account name, transaction amount, transaction date, payment reference, invoice number, proof of payment, remittance information, and other information reasonably necessary to identify and reconcile the payment.

11.4 PAYMENT AND IDENTITY VERIFICATION

For suspected fraud, unusual transactions, disputed payments, high-value transactions, regulatory requirements, identity verification, or another legitimate verification purpose, we may request additional information reasonably necessary to verify the transaction.

This may include proof of payment, business identification, proof of address, a relevant bank or card statement, government-issued identification, corporate documentation, or authorization documentation.

Where practical, unrelated information should be redacted before submission.

We do not intentionally request more financial or identification information than reasonably necessary.

12.TESTIMONIALS, REVIEWS, PHOTOGRAPHS, AND CASE STUDIES

If you provide us with a testimonial, review, photograph, video, installation image, case study, quotation, or other material for publication, we will use the material in accordance with your authorization and applicable law.

We may identify the contributor using information that the contributor has authorized for publication, such as first or full name, company, title, general location, photograph, or relevant product information.

We will not intentionally make private customer-support, warranty, payment, or transaction information public merely because a customer has provided a testimonial.

13.INFORMATION FROM THIRD PARTIES

We may receive personal information from customers, suppliers, distributors, payment providers, financial institutions, shipping providers, Service Providers, professional advisers, event organizers, business partners, and publicly available professional or business sources where reasonably necessary for legitimate business purposes.

Information obtained from third parties is subject to applicable privacy requirements.

14.SERVICE PROVIDERS AND DISCLOSURE OF INFORMATION

4Dsensing may use third parties to perform legitimate business functions, including Website hosting and e-commerce infrastructure, information technology, cloud services, cybersecurity, email and communications, analytics, marketing communications, payment processing, banking, accounting, shipping, freight and logistics, customer support, professional services, legal services, insurance, and other necessary business services.

We seek to provide Service Providers only the personal information reasonably necessary for their function.

Where appropriate, we use contractual protections, confidentiality obligations, technical safeguards, organizational controls, access restrictions, and Service Provider due diligence.

4Dsensing remains responsible for personal information under its control as required by applicable law, including where a third party processes information on our behalf.

15.OTHER DISCLOSURES

We may disclose personal information where you direct or authorize us to do so.

We may provide appropriate information to couriers, postal services, freight companies, customs brokers, logistics providers, and customs authorities where reasonably necessary to deliver products.

We may provide appropriate information to lawyers, accountants, auditors, insurers, consultants, and other professional advisers where reasonably necessary.

We may use or disclose information where permitted or required by law, including to comply with legal obligations; respond to a court order, warrant, subpoena, or other lawful process; investigate fraud or unlawful conduct; respond to a security incident; enforce contractual rights; collect legitimate debts; protect our systems, property, personnel, customers, or others; or establish, exercise, or defend legal claims.

Information may also be disclosed where reasonably necessary in connection with an actual or proposed financing, investment, merger, acquisition, restructuring, reorganization, sale of assets, or transfer of business. Appropriate confidentiality measures will be used where required.

16.SALE OF PERSONAL INFORMATION

4Dsensing does not sell personal information for monetary consideration.

We do not intentionally disclose personal information to unrelated third parties for their independent direct-marketing purposes without the consent required by applicable law.

The use of a Service Provider to perform functions on behalf of 4Dsensing is not treated by 4Dsensing as a sale of personal information.

17.CROSS-BORDER AND INTERPROVINCIAL PROCESSING

4Dsensing is based in Ontario, Canada.

Some Service Providers may process or store personal information in another Canadian province, in the United States, or in another jurisdiction.

Personal information processed outside the individual’s province or country may be subject to the laws of that jurisdiction and may be accessible to courts, law-enforcement authorities, regulators, national-security authorities, or other government authorities where permitted by applicable law.

4Dsensing remains responsible for personal information under its control as required by applicable law and uses appropriate measures for Service Provider relationships.

18.QUEBEC PRIVACY IMPACT ASSESSMENTS AND TRANSFERS

Where Quebec privacy legislation applies, 4Dsensing will conduct a privacy impact assessment before communicating personal information outside Quebec or entrusting applicable collection, use, communication, or retention activities outside Quebec where such an assessment is required by law.

The assessment may consider the sensitivity of the information, the purposes for which it will be used, the protection measures in place, contractual protections, the applicable legal framework, and other circumstances required by law.

Where required, a transfer or processing arrangement will be governed by a written agreement that considers the results of the assessment and provides appropriate safeguards.

4Dsensing will also conduct privacy impact assessments for other systems, projects, or electronic-service initiatives where applicable law requires them.

19.RETENTION AND DESTRUCTION

We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, legitimate business requirements, legal requirements, accounting and taxation, transaction records, warranty obligations, service records, fraud prevention, security, insurance, contractual obligations, dispute resolution, and legal claims.

Different categories of information may have different retention periods.

Where applicable law requires us to provide retention information upon request, we will do so.

When personal information is no longer reasonably required, we take appropriate measures to delete it, securely destroy it, securely dispose of it, or anonymize it where permitted and appropriate.

Information subject to litigation, investigation, legal hold, outstanding payment, an active warranty matter, a dispute, or another legal requirement may be retained until the relevant requirement has been resolved.

20.ACCURACY

4Dsensing takes reasonable steps to keep personal information sufficiently accurate, complete, and current for the purposes for which it is used.

The degree of accuracy required depends upon the nature of the information, its purpose, its sensitivity, and the consequences of an error.

You may contact us to request correction of personal information that you believe is inaccurate or incomplete.

21.SECURITY

4Dsensing uses administrative, organizational, technical, and physical safeguards appropriate to the sensitivity and circumstances of personal information under our control.

Depending on the information and system involved, measures may include access controls, authentication, encryption, secure communications, network protections, firewalls, security monitoring, system logging, software updates, security patches, restricted administrative access, backup procedures, confidentiality obligations, secure disposal procedures, personnel awareness, and Service Provider controls.

Access to personal information is limited according to legitimate business requirements.

No Website, Internet transmission, email system, computer system, or electronic-storage method can be guaranteed to be completely secure.

Accordingly, 4Dsensing cannot guarantee absolute security.

22.PRIVACY AND SECURITY INCIDENTS

4Dsensing maintains procedures for responding to suspected privacy and security incidents.

Where appropriate, we will investigate the incident, take reasonable measures to contain it, evaluate affected information, assess the risk of harm, take corrective action, preserve required records, notify individuals where required, notify regulators where required, and take steps intended to reduce the likelihood of recurrence.

22.1 FEDERAL PIPEDA REQUIREMENTS

Where PIPEDA applies, we will report and notify qualifying breaches of security safeguards where required by law.

We will maintain records of breaches of security safeguards for the period prescribed by applicable federal law.

22.2 QUEBEC CONFIDENTIALITY INCIDENTS

Where Quebec privacy legislation applies, 4Dsensing maintains a register of confidentiality incidents involving personal information.

The register includes incidents required to be recorded by Quebec law, including applicable incidents that do not present a risk of serious harm.

Where an incident presents a risk of serious harm, we will notify the Commission d’accès à l’information du Québec and affected individuals as required by law.

Quebec incident records will be maintained for at least the minimum period required by applicable law.

23.YOUR PRIVACY RIGHTS

Depending on applicable law and the circumstances, you may have the right to request access to personal information under our control concerning you, information about how it has been used and disclosed, correction of inaccurate or incomplete information, withdrawal of consent where processing relies upon consent, deletion where applicable, and the ability to challenge our compliance with applicable privacy requirements.

We may require appropriate identity verification before disclosing information or completing certain requests.

Deletion may not be available where information must reasonably or legally be retained for accounting, taxation, completed transactions, warranty obligations, fraud prevention, security, insurance, contracts, disputes, or legal claims.

24.ADDITIONAL QUEBEC PRIVACY RIGHTS

Where Quebec privacy legislation applies, additional rights may be available subject to statutory conditions and exceptions.

24.1 DATA PORTABILITY

You may request qualifying computerized personal information collected from you in a structured and commonly used technological format.

Where legally applicable, you may request that qualifying information be communicated to another authorized person or organization.

This right is subject to applicable limitations and generally does not include information created or inferred by 4Dsensing.

24.2 CESSATION OF DISSEMINATION AND DE-INDEXATION

In circumstances established by Quebec law, you may request that we cease disseminating certain personal information, de-index a hyperlink associated with your name, or re-index an applicable hyperlink.

These rights are conditional and will be assessed according to the criteria required by applicable law.

25.CHILDREN AND MINORS

The Website is intended primarily for customers, prospective customers, businesses, professionals, suppliers, technicians, contractors, property owners, and other persons seeking information concerning our products or services.

The Website is not directed to children.

We do not knowingly seek to collect personal information from minors where parental or guardian consent would be legally required.

Where Quebec privacy legislation applies, personal information concerning a minor under 14 will not knowingly be collected directly from the minor without the consent of the holder of parental authority or tutor where such consent is required, subject to exceptions permitted by law.

If you believe a minor has provided us with personal information contrary to applicable law, contact our Privacy Officer.

26.THIRD-PARTY WEBSITES, SOCIAL MEDIA, AND EXTERNAL SERVICES

The Website may contain links to social-media services, payment services, shipping services, suppliers, partners, video or media services, professional platforms, or other third-party websites.

Independent third parties control their own privacy, security, and information-handling practices.

A link does not mean that 4Dsensing controls or assumes responsibility for the third party’s privacy practices.

Information you provide directly to an independent third party is generally governed by that party’s own privacy policy and terms.

27.PRIVACY REQUEST VERIFICATION

Before responding to an access, correction, portability, deletion, or similar privacy request, we may take reasonable steps to verify your identity and your authority to make the request.

Verification will be proportionate to the sensitivity of the information, the nature of the request, and the risk of unauthorized disclosure.

We will seek to avoid collecting unnecessary identification information during verification.

28.PRIVACY COMPLAINTS

You may contact our Privacy Officer regarding any concern about our handling of personal information.

We will review the matter and take appropriate action.

If you are not satisfied with our response, you may have the right to contact an applicable privacy regulator, including, depending upon jurisdiction, the Office of the Privacy Commissioner of Canada, the Commission d’accès à l’information du Québec, or another provincial, territorial, or foreign privacy authority having jurisdiction.

29.CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time to reflect changes involving our Website, business activities, information practices, payment methods, payment-link providers, cookies, analytics, marketing technologies, Service Providers, technology, security, legal requirements, or regulatory guidance.

The Last Updated date at the beginning of the Policy identifies the current published version.

Where required by law, we will provide additional notice before a material change becomes effective.

Where applicable law requires new consent for a materially different collection, use, or disclosure, merely updating this Privacy Policy will not substitute for that required consent.
